OMNI is not a rideshare carrier or transportation provider. Instead, OMNI functions as a technology and marketing partner, enabling Riders to connect with independent third-party transportation providers, affiliates, or sponsors (“Third-Party Providers”). This Privacy Policy (“Policy”) explains how OMNI collects, uses, discloses, and safeguards your information when you interact with our Services within California and, where applicable, in the United States.

By accessing or using the OMNI Services, you expressly consent to the practices described in this Policy. If you disagree with any part, discontinue using the Services immediately.


1. INFORMATION WE COLLECT

1.1 Personal Information You Provide

We may collect personal information voluntarily provided by you, including:

  • Identifiers: name, phone number, email address, mailing address.

  • Payment Information: credit/debit card number, billing address, transaction history (processed securely by third-party payment processors).

  • Profile Information: profile photo, username, or other account details.

Collection Method & Legal Basis:

  • Directly from you during registration, ride requests, or support interactions.

  • Legal bases include: contractual necessity (to facilitate rides), consent (marketing), and legitimate interest (fraud prevention).

1.2 Automatically Collected Information

When you use OMNI Services, we automatically collect:

  • Device Data: IP address, browser type, operating system, device identifiers.

  • Usage Data: pages viewed, in-app activity, session duration, referral links.

  • Location Data (with consent): GPS or network-based data for pickups/navigation.

Purposes:

  • Security and fraud detection.

  • Service optimization.

  • Personalized promotions and marketing.

1.3 Information from Third Parties

We may receive additional Rider data from:

  • Authentication Providers: Apple, Google, Facebook.

  • Corporate Partners or Affiliates: if rides are subsidized or linked to promotions.

  • Payment Processors: billing validation and fraud alerts.


2. HOW WE USE YOUR INFORMATION

OMNI uses Rider data to:

  • Enable the technology platform and connect you with Third-Party Providers.

  • Process payments and send receipts.

  • Provide customer support, resolve disputes, and enforce our Terms of Service.

  • Personalize offers, marketing, and sponsored promotions.

  • Comply with applicable California and federal laws.

We may also use data for analytics, retargeting campaigns, AI-based fraud detection, and safety monitoring.


3. SHARING YOUR INFORMATION

OMNI does not sell your personal information as defined under the California Consumer Privacy Act (CCPA/CPRA). However, we may share data with:

  • Third-Party Providers: independent transportation providers fulfilling Rider requests.

  • Service Vendors: hosting, analytics, payment processors, and marketing agencies under confidentiality obligations.

  • Corporate Affiliates & Sponsors: if your ride was booked via a promotional program.

  • Legal Authorities: to comply with subpoenas, law enforcement, or regulatory requirements.

  • Business Transactions: in case of merger, sale, or acquisition.


4. CALIFORNIA PRIVACY RIGHTS

Under CCPA/CPRA, California Riders have the right to:

  • Know what categories of data we collect, use, and disclose.

  • Access copies of personal information in portable format.

  • Request Deletion of personal data (subject to business/legal exceptions).

  • Opt-Out of “sharing” for targeted advertising purposes.

  • Correct inaccurate information.

  • Limit Use of sensitive data.

You may exercise these rights by emailing privacy@ridewithomni.com. We will verify your identity and respond within 45 days as required by law.


5. SECURITY MEASURES

OMNI employs industry-standard safeguards:

  • Encryption: TLS/SSL for transmissions; standard encryption for stored sensitive data.

  • Access Controls: role-based employee access; multi-factor authentication.

  • Monitoring: 24/7 threat detection, regular audits.

  • Incident Response: breach notification protocols per California Civil Code § 1798.82.

While we work to protect your data, no method of transmission is completely secure. You share responsibility for securing your devices and passwords.


6. CHILDREN’S PRIVACY

OMNI does not knowingly collect data from children under 13 years old in compliance with COPPA (Children’s Online Privacy Protection Act).

  • If we learn a child’s information was collected without parental consent, we will delete it promptly.

  • Riders under 18 must use OMNI only with parental or guardian supervision.


7. COOKIES & TRACKING

We use cookies, SDKs, and similar technologies for:

  • Session authentication.

  • Performance and analytics.

  • Advertising and retargeting (with opt-out options).

California users may adjust cookie preferences in-browser or via our in-app controls.


8. DATA RETENTION

We retain Rider information only as long as necessary to:

  • Fulfill ride facilitation and payment obligations.

  • Comply with tax, audit, and legal requirements (typically up to 7 years for payment records).

  • Resolve disputes or enforce agreements.

When data is no longer required, it will be securely deleted or anonymized.


9. CROSS-BORDER DATA TRANSFERS

OMNI may store or process Rider data in the United States or other jurisdictions. If information is transferred outside California, we ensure compliance with U.S. data transfer rules and comparable safeguards.


10. THIRD-PARTY LINKS

Our Services may contain links to unaffiliated third-party websites. OMNI is not responsible for the privacy practices of these external sites. We encourage Riders to review third-party privacy policies.


11. DO NOT TRACK (DNT)

Because no uniform industry standard has been established, OMNI does not respond to browser “Do Not Track” signals. Riders may still opt-out of targeted advertising through in-app settings or device preferences.


12. ENFORCEMENT & DISPUTES

If you believe OMNI is not adhering to this Policy:

  • Email us at privacy@ridewithomni.com with “Privacy Violation” in the subject line.

  • We will investigate promptly.

  • If unresolved, California residents may contact the California Privacy Protection Agency (CPPA) or the California Attorney General.

Disputes regarding this Policy may also be resolved via arbitration, consistent with OMNI’s Terms of Service.


13. CHANGES TO THIS POLICY

We may revise this Policy periodically to reflect legal, technical, or business changes.

  • Updates take effect immediately upon posting.

  • Significant changes will be communicated through the App, email, or website notices.

BINDING AGREEMENT & ACKNOWLEDGMENT

By using OMNI Services, you confirm you have read, understood, and agreed to this Privacy Policy. If you do not agree, you must discontinue use of the Services.

Omni connects you with these drivers and gives you an easy way to book a ride, but we do not provide transportation directly. Trip matters like vehicle condition, cleanliness, or conduct during a ride are the responsibility of the driver. Omni’s role is to offer technology tools and support to make your ride experience simple, fair, and transparent.
